At The Millen House, we curate and sell unique artworks, design objects, and vintage pieces. Each work is special — sometimes one-of-a-kind, sometimes carrying traces of age that add to its character. Because of this uniqueness and delicacy, we ask clients to review pieces carefully before purchasing. We are happy to provide additional photographs, condition reports, or details upon request.

All purchases are final, but we will always assist with transport and installation advice to ensure your new piece arrives safely and securely.

 



1. General

These Terms & Conditions apply to all offers, sales, and agreements with The Millen House, based in Amsterdam, The Netherlands (hereinafter: “the Gallery”). By placing an order or entering into an agreement with the Gallery, the client accepts these Terms & Conditions.

Any terms from the client are expressly excluded unless agreed to in writing.

 



2. Nature of Works

The Gallery offers artworks, design objects, and vintage pieces. Many works are unique, handmade, and/or historic. Vintage items in particular may show traces of age, including scratches, craquelé, wear, or minor discolouration. Such characteristics are part of their authenticity and are not considered defects.

All works are sold “as seen” and “as is.” Clients are encouraged to request additional photographs, condition reports, or information before purchasing.

 



3. Offers & Agreements

  • All offers are without obligation unless a time for acceptance is specified.

  • An agreement is concluded only when confirmed in writing by the Gallery.

  • Any changes made by the client to an offer count as a rejection of the original offer unless confirmed otherwise by the Gallery.



4. Prices & Payment

  • All prices are in euros (€) and inclusive of VAT unless stated otherwise.

  • Any additional costs (such as storage, shipping, insurance, installation, or customs duties) are for the account of the client, unless otherwise agreed in writing.

  • Payment must be made within 7 days of the invoice date, unless agreed otherwise. Works remain property of the Gallery until full payment is received.

  • In the event of late payment, the Gallery may charge statutory interest and collection costs.



5. Shipping & Delivery

  • Works are delivered from Amsterdam. Risk transfers to the client once the work is handed over for packing or transport.

  • Shipping costs depend on the size, weight, value, and destination of the item and will be quoted individually.

  • The Gallery will advise on the best shipping method, but final responsibility for transport, insurance, and customs clearance lies with the client.

  • If the client does not collect a work on the agreed date, storage costs may apply.



6. Condition, Returns & Guarantees

  • All works offered by The Millen House are unique artworks, design objects, or vintage pieces. Due to their one-of-a-kind and delicate nature, they are sold “as seen” and “as is.” Vintage items may show traces of age such as scratches, craquelé, wear, or minor discolouration, which are considered part of their authenticity rather than defects.

  • All sales are final. No returns or exchanges are accepted.

  • In accordance with Article 6:230p of the Dutch Civil Code, the statutory EU right of withdrawal does not apply to:

    • custom-made or personalised works,

    • artworks and unique design objects, and

    • vintage or fragile goods that by nature cannot be returned safely.

  • Clients are encouraged to request additional photographs, condition reports, or to view works in person before making a purchase. The Gallery is happy to provide all reasonable information to assist in an informed decision.

  • After delivery, the Gallery cannot guarantee lifespan, functionality, or future condition of the work, and is not liable for damage, wear, or deterioration once the work has passed into the client’s care.


7. Intellectual Property & Use

  • All intellectual property rights in relation to the works remain with the artist, designer, or the Gallery.

  • Works may not be copied, reproduced, or used for commercial purposes without prior written consent.

  • The Gallery reserves the right to photograph works and use these images for promotional purposes.



8. Liability

  • The Gallery is not liable for indirect damages (such as loss of profit or business interruption).

  • Any direct liability is limited to the purchase price of the work concerned, with a maximum of €25,000.

  • The Gallery cannot be held responsible for damages caused during shipping, installation, or by third parties.



9. Force Majeure

The Gallery is not liable for delays or non-performance caused by events outside its reasonable control, including strikes, accidents, supplier delays, transport disruptions, war, or government measures.



10. Termination

The Gallery may suspend or terminate agreements if the client fails to meet payment or other obligations.



11. Applicable Law & Disputes

All agreements are governed exclusively by Dutch law. Any disputes shall be settled by the competent court in Amsterdam, The Netherlands.


12. Acceptance of Terms

By purchasing from The Millen House, whether online, by email, or in person, the client acknowledges and accepts these Terms & Conditions in full.
